Modesona Terms of Use

1. Who can use Modesona

You must be at least 16 years old to use the Service. By using it you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf. We may ask for proof of age and may close accounts that do not meet this requirement.

2. Your account

An account is required to use the app. You can sign in with Apple, Google or an email address. You are responsible for keeping your sign-in details private and for everything that happens under your account. Tell us at info@appgeneration.com immediately if you think someone else is using it.

You may delete your account at any time from Settings → Account → Delete account. Deletion is permanent: your wardrobe, photos, looks and profile are removed as described in the Privacy Policy.

3. What the Service does — and what it is not

Modesona uses artificial intelligence to digitise the clothes you photograph, classify them, suggest outfits from what you own, render a Virtual Try-On on a photo you provide, evaluate outfits, plan trips and suggest items you might buy.

Modesona gives style suggestions, not guarantees. Its outputs are generated by AI models and can be wrong, incomplete or not to your taste. In particular:

• ○Garment recognition may misidentify a category, colour, brand, fabric or season. You can correct any attribute in the app.
• ○Outfit suggestions and scores reflect general style principles and your stated preferences; they are opinions, not facts.
• ○Virtual Try-On renders are AI-generated images. They approximate how an item might look on you; they do not show real fit, drape, size or colour accuracy, and should not be relied on to decide a size. See section 8 on AI-generated images.
• ○Shopping suggestions do not guarantee that an item exists, is in stock, is priced as shown or will fit. Purchases from retailers are governed by the retailer's terms, not ours.
• ○Weather-based suggestions depend on third-party forecasts, which may be inaccurate.

The Service is not medical, health, body-image or professional styling advice. If any feature makes you feel judged about your body, please stop using it and tell us — that is not what we want.

4. Your content

"Your Content" means everything you upload or create in the Service: photos of clothes, photos of yourself, product images and links, your style profile, messages to the Stylist, and the outfits, looks and trips you save.

You own Your Content. We claim no ownership of it, we do not sell it, and we do not give it to third parties for their own purposes. We store and process it only to provide the Service to you, and to improve Modesona as described in section 5 and in the Privacy Policy.

Your responsibilities. You confirm that you have the right to upload Your Content — in particular, that any person shown in a photo is you, or an adult who has agreed to appear in it. You must not upload photos of other people without their permission, photos of any other person under 18 for Virtual Try-On or Rate my look, or content that is unlawful, sexually explicit, hateful, harassing or infringes anyone's rights. We use automated filters and may review content that is reported. We may remove content and suspend accounts that break these rules.

5. How we use Your Content to improve Modesona

To make garment recognition and outfit suggestions better for everyone, we use clothing scans, the item attributes you correct, product images you import, and your outfit feedback (saves, 👍/👎, outfits marked as worn, ratings and Stylist requests) to train and evaluate the AI models that power Modesona.

This data is de-identified before it is used, is used only for models operated by or for Modesona, and is never shared with third parties to train their models. Photos of you (try-on and Rate my look photos) are never used for this.

You can turn this off at any time with the "Help us improve Modesona" setting in the app. Full details, including what happens when you delete your account, are in section 4 of the Privacy Policy.

6. Acceptable use

You agree not to:

• ○use the Service for any unlawful purpose or in breach of these Terms;
• ○use the Service commercially — for example, to provide styling services to others, or to build a catalogue for resale — without our written agreement;
• ○copy, scrape, crawl, reverse-engineer, decompile or extract data or models from the Service, or use automated tools to access it;
• ○attempt to access other users' accounts or data, or to bypass free-plan limits, security or payment mechanisms;
• ○upload malware or interfere with the Service's operation;
• ○use outputs of the Service to create a competing product or to train other AI models;
• ○misrepresent AI-generated images as real photographs (see section 8).

7. Plans, subscriptions and payments

7.1 Free plan

The free plan gives you access to core features with limits (for example on the number of wardrobe items, outfit suggestions, try-ons, scans and stylist messages). Current limits are shown in the app and may change; we will not reduce limits for existing users without notice.

7.2 Pro subscription

Pro removes those limits and unlocks all features. Pro is sold as an auto-renewing monthly or annual subscription, through:

• ○the Apple App Store (billed to your Apple ID);
• ○Google Play (billed to your Google account);
• ○modesona.com, billed by card through our web checkout.

Prices are shown in the store or checkout in your local currency before you confirm. Prices differ by country and platform. Taxes may be added where required.

7.3 Free trial

Some plans start with a free trial (currently 3 days). You will be charged the full subscription price automatically when the trial ends unless you cancel at least 24 hours before it ends. One trial per person; we may refuse further trials to accounts that have already used one.

7.4 Renewal and cancellation

Subscriptions renew automatically at the end of each period at the then-current price unless cancelled at least 24 hours before the end of the current period. You keep Pro access until the end of the period you paid for. After that, your wardrobe, outfits and looks are kept for 3 months so you can come back to them (or keep using them within the free-plan limits); see section 8 of the Privacy Policy.

Uninstalling the app does not cancel a subscription.

7.5 Refunds and right of withdrawal

• ○Purchases through the App Store or Google Play are handled by Apple or Google under their refund policies; we cannot issue refunds for them directly. Request a refund at https://reportaproblem.apple.com or through Google Play support.
• ○Purchases on modesona.com: if you are a consumer in the EU, UK or another jurisdiction with a statutory right of withdrawal, you may withdraw within 14 days of purchase without giving a reason by emailing info@appgeneration.com. Because Pro is delivered immediately, you expressly agree at checkout that the service starts right away and that, if you withdraw, we may deduct an amount proportional to the days of Pro you have used. Where the law provides a longer or unconditional right, that right applies.
• ○Nothing in this section limits your statutory rights as a consumer.

7.6 Lifetime plan

Where offered, "Modesona Pro Lifetime" is a one-time purchase that gives Pro access for as long as we operate the Service, on the platform where you bought it. Because AI features have a real per-use cost, Lifetime includes a fair-use allowance for Virtual Try-On and Stylist messages (currently shown in the app and on our help pages); wardrobe items and outfit suggestions are unlimited. We may adjust the allowance over time, but never below what was shown when you bought it. Lifetime is tied to your Apple ID or Google account; restore it on a new device with "Restore purchases".

7.7 Price changes

We may change subscription prices. For existing subscribers, the store (Apple or Google) or we (for web plans) will notify you before a higher price applies, and where required by the store or the law you will be asked to agree; if you do not agree, your subscription ends at the end of the current period.

7.8 Access across platforms

A subscription bought on one platform (for example on the web) works in the app on iOS and Android when you sign in with the same account. Purchases made in the app are managed by the store you used.

8. AI-generated images and sharing

Virtual Try-On renders and other images generated by Modesona are created by AI. They are provided for your personal use to help you decide what to wear or buy. When you share or export them, the app marks them as AI-generated; you must not remove that mark or present such images as genuine photographs, use them to deceive anyone, or use them in a way that harms the person shown. You are solely responsible for what you share.

9. Third-party services and links

The Service contains links to retailers and other third-party sites. Some are affiliate links, meaning we may earn a commission if you buy — at no extra cost to you. We do not control those sites, are not a party to your purchase, and are not responsible for their products, prices, availability, delivery, returns or privacy practices.

10. Our intellectual property

The Service — including its software, models, design, text, graphics, fashion course content and trademarks (Modesona, and previously AI Closet) — belongs to AppGeneration or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms. All other rights are reserved.

If you believe content available through the Service infringes your rights, email info@appgeneration.com with: identification of the material and where it appears, your contact details, a statement that you believe in good faith the use is unauthorised, and your signature (physical or electronic). We will remove infringing material and may close repeat infringers' accounts.

11. Feedback

If you send us ideas or suggestions about the Service, we may use them without any obligation to you. We will not use your name in connection with them without your consent.

12. Changes to the Service

We are constantly improving Modesona. We may add, change or remove features, and may discontinue the Service or a part of it. If a change materially reduces what a paid plan includes, we will tell you in advance and, if you are on a plan that cannot be cancelled with a refund, offer a proportional refund of the remaining period.

13. Suspension and termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your account, with notice where reasonably possible, if you materially breach these Terms, if required by law, or if the Service is discontinued. If we terminate for a reason other than your breach, we will refund any prepaid, unused subscription period where we are the seller (web plans) and ask the store to do the same for store purchases. Sections that by their nature should survive termination (4, 5, 6, 10, 14, 15 and 17) survive.

14. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties that the Service will be uninterrupted, error-free or that its AI outputs will be accurate, complete or suitable for any particular purpose. Nothing in these Terms excludes warranties or rights that cannot be excluded under the consumer laws of your country of residence, including the conformity guarantees for digital services under EU law.

15. Liability

To the extent permitted by law, our total liability to you for all claims arising out of or related to the Service in any 12-month period is limited to the amount you paid us for the Service in that period (or €50 if you paid nothing). We are not liable for indirect or consequential loss, loss of data that you could reasonably have backed up, or losses caused by third-party retailers or services.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or for anything else that cannot be limited under applicable law. If you are a consumer, you retain all mandatory rights under the law of your country of residence.

16. Apple and Google

If you downloaded the app from the App Store: these Terms are between you and AppGeneration, not Apple; Apple has no obligation to provide maintenance or support; Apple is not responsible for any claim relating to the app or your use of it, including product-liability, legal-compliance and intellectual-property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where Apple's standard EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) conflicts with these Terms, these Terms prevail to the extent permitted.

If you downloaded the app from Google Play, the Google Play Terms of Service also apply to the download and to in-app purchases.

17. Governing law and disputes

These Terms are governed by Portuguese law. If you are a consumer living in another country, you also benefit from the mandatory consumer-protection rules of that country.

If you have a problem, please write to info@appgeneration.com first — most issues are solved quickly.

18. Changes to these Terms

We may update these Terms. We will post the new version with a new effective date and, for material changes, notify you in the app or by email at least 30 days before they take effect. If you keep using the Service after that date, the new Terms apply. If you do not agree, you may cancel your subscription and delete your account before they take effect.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms; we may transfer ours to a successor of the business with notice to you. These Terms, together with the Privacy Policy and any plan-specific terms shown at purchase, are the entire agreement between us regarding the Service. Where we provide translations, the English version prevails in case of conflict, except where local law requires otherwise.
